Benjamin Frazier, 41, who has a lengthy previous arrest record went into Drai’s nightclub on Oct. 21, grumbled about the admission charge of $30, and asked if he could walk around the club first before he paid.
Club staff obliged.
He then returned to the admissions area and argued with one of the employees, a scuffle ensued and Frazier pulled out a gun and shot two employees of he club.
As Frazier is walking away, Kenneth Brown, a comedian who was also in the club, jumped on Frazier in an attempt to subdue him.
Brown was shot and killed by Frazier.
Frazier was injured in the melee and was placed a medically induced coma.
He has since recovered.
It would appear that with the release of the explosive Las Vegas nightclub shooting video which resulted in the murder of Brown, that Frazier would not have much of a defense, however, his legal team believes otherwise.
It looks like defense attorney Vicky Greco’s, strategy is to deflect blame onto the deceased Good Samaritan, Kenneth Brown.
Greco said that he jumped Frazier from behind and that if Frazier really had an intent to kill, then all three would be dead.
It also appears that because because Frazier was allegedly under the influence of pills and alcohol, that he apparently ingested voluntarily, that his legal team team is claiming some type of impairment in his judgement.
Greco was accompanied by Frazier’s uncle, disgraced Nye County District Attorney Bob Beckett who stood quietly by her side.
Will Greco be able to score a win and perhaps try the poor man’s version of an “Affluenza” defense?
Or perhaps his defense team will use the “Memorenza” defense where one is voluntarily impaired but since they can’t remember a thing, should be excused for their actions.
Frazier could be facing a death penalty for murdering Brown.
