Chavarin told police that he became embroiled in an argument with another man about the music being played on the jukebox.
He said that the man started swearing him and pushing his buttons.
Chavarin claims that he thought the man was going to hit him so he hit him first.
When the victim hit the ground and lost consciousness, Chavarin says he tried to help the man.
He said it was not his intention to seriously hurt the victim and the police report indicated that he waited for the police and accepted full responsibility.
Chavarin was arrested on a charge of open murder.
An open murder charge means that a judge or jury will be able to decide what type of murder charge the defendant will face.
Initially Chavarin was held without bail at the CCDC.
At his Feb. 5 court appearance, bail was granted with the condition that Chavarin would be released on house arrest.
He has since posted bail but has not yet submitted the house arrest package to the court.
Update: The man killed has been identified as 41-year-old Phillip Matthews.
